Jisc negotiated changes to Microsoft's standard Office 365 Agreement in order to secure an enhanced position for the benefit of institutions wishing to procure Office 365.

The negotiated amendments cover areas including:

  • Standard liability

  • Privacy and security measures

  • Clarification of jurisdiction and legal precedence, etc.

Jisc's legal adviser carries out a yearly review of Microsoft's Online Service Terms (OSTs).

Please note that in order to use the Jisc amendments, Office 365 licenses must be ordered on an Institution's Campus agreement. This is done via your reseller.

If you've signed up for O365 online and you later wish to use the Jisc amendments, contact us for details about the process of signing up. Once we confirm your eligibility with Microsoft, you can then order the licenses through your reseller and assign those to your users.

Organisations that use the Jisc-amended agreement may be eligible to also use the Google Apps for Education (now G Suite) amended agreement by paying a single fee of £500 yearly.

Following the EU Court decision on Safe Harbour earlier this week, whereby EU-US data transfers are 'invalid' if made under the 'safe harbour' regime, our solicitor has advised that where a cloud arrangement includes the Model Clauses, e.g. Microsoft’s OSTs, then the ruling should have limited immediate impact.

Janet and Microsoft have also agreed further updates to the O365 agreement. These are available to organisations signing up for O365 for the first time or when renewing their agreement with Microsoft.

Organisations that already use Version 1 of the Janet amendments will continue to do so and will be offered Version 2 when their Microsoft agreement becomes due for renewal.
